(Termination of Lease) and refunding caution of EUR400 as of XXXX
Dear Mr. xxx,
I would like to discuss some issues about the termination of my apartment lease with you. I have sent to your mother the letter de recommande avec reception for the termination of my apartment lease (resiliation du bail), which says that I would leave the apartment on 16 June 2013, and I would like your mother (Mme xxx) should come to the apartment on this day to check the status and particularly refunding me the caution. This letter has been received by Mme xxx on 13 May 2013.
I have also posted the cheque (N° ) with the amount of 410 euro as the rent of May in the same letter de recommendé. The cheque (N°) has been cashed on 14 May 2013 by Mme xxx, which is stated clearly on my bank statement! But till now I did not received any reception of rent (Quitance de loyer – May 2013). Hence I required from you, that you state that the payment has been made, otherwise it mistreats our owner/tenant contract. It is in your hand to avoid any charges against you. I am also in contact with a lawyer in order to start procedures to receive my money, if you do not show any cooperation.
I have posted the rent for June 2013 by cheque (N° ) with the amount of EUR205 by letter de recommende (N° 1A 087 816 48589) avec reception at 06 June 2013. And I have been informed by post office that this letter have been posted to Rouen city on 12 June 2013 to M XXXX ‘s current address.
Yesterday I have talked to your mother Mme XX by mobile phone and explained her in detail my intended leave and the refunding issues. Obviously, she received the letter de recommende (N° 1A 087 816 48589). According to your mother’s statement, she refused to cash the cheque ( N° ) as she claimed tha she would receive the money only 2 weeks after cashing it. This is in my view only an excuse!!!
See below:
• 11th May, I sent the letter de recommende - including the Chque
• 13th May, xxx received the letter de recommende & Cheque for Rent May.
• 14th May, xxx cashed the cheque;
• 15th May, I find the 410 euro has been cashed (my bank bills of May stated )
So it is clear that the delay of cashing the cheque till the money arrived to the receiver’s bank account is just 2 days.
How could your mother use a 2 week delay as an excuse to refuse to cash my chèque? At the same time she order me to pay the June’s rent by cash. Also she stated that – for the refunding issues, she will refund 400 euro by chèque. This is very unfair – to ask me to pay it by cash and she only wants to refund me by chèque.
During our talking, I mentioned that she did not give me the 2 reception of rent (May & June 2013). Your mother asked me for what I need it since I will leave the apartment soon. I don’t have to tell anyone for what I need it, but I know that it is my right to get the reception of payment rent!
Thirdly, your mother insisted to keep the chèque (N°) – 205 euro, she said she will not cash it, and she order me to pay the June’s rent by cash on 16 June 2013. At the same time, she will not refunding my caution by cheques issued by Mme. XXX. This is totally unacceptable!
To Solute the money transfer issues, I propose the following 2 methods:
Case A. Your mother return the Chèque (N° ) – EUR205, and she give me a new Cheque with the amount of EUR195 (EUR400 caution – EUR205 June’s rent).
Case B. She can keep the chèque (N° ) – EUR205 and cash it. But she gives me an new Cheque with the amonot of EUR400 (caution amount).
Anyway, I will definitely not pay the June’s rent by cash.
I ask you again for your cooperation to resolve the issue!
