how to get benefit for 6 weeks before and 8 weeks after birth

My working contract finished at end of September 2008. My 6 weeks before due-date is 7 Oct 2008. So my company doesn't want to extend the contract but they can continue hiring me 8 weeks afterbirth if I want to continue work.
Then my company's HR suggested me to go to AOK to ask for benefit for 6 weeks before and 8 weeks after birth, 13 Euro per day. I went AOK< they said No because I don't have a contract for this 6+8 weeks, so no incoming to compensate.

So where I should get those above benefit?

Another question: I plan to, not working, stay at home one year after birth. So can I apply for the parents-money from the family office(300E per month)? What is the condition to have this benefit money? Do I need to have some kind of contract to apply for this?
